Credit Counseling Before Filing for Bankruptcy

Those who are in debt and wish to file Chapter 7 or Chapter 13 bankruptcy under the United States Bankruptcy code will need to participate in an approved credit counseling course.

While many agenices provide credit counseling, the agency and the course they provide must be approved by the United States Trustee to meet the requirements of the 2005 bankruptcy law changes. The course must follow the guidelines established by the U.S. Trustee for content and length. Debt Education and Certification Foundation has been approved to provide this pre-bankruptcy counseling. All debtors filing bankruptcy must complete a certified course within 180 days prior to the filing of a bankruptcy petition (exceptions may apply for emergency filings).
